1什么是海外人才居住证（B证）？

　　

Theresidencepermitforoverseastalentsistheproofthattheholderworks,livesandenjoysrelevanttreatmentinthecity.

　　

海外人才居住证是持证人在本市工作、生活并享受相关待遇的证明。

　　

Theresidencepermitforoverseastalentsisdividedintomasterpermitandattendantpermit.Qualifiedoverseastalentscanapplyformastercard,andtheirspousesandchildrenunder18yearsoldorstudyinginhighschoolcanapplyforaccompanyingcard.

　　

海外人才居住证分为主证和随员证。符合条件的海外人才可以申请主证，其配偶和未满18周岁或者高中在读的子女可以申请随员证。

2海外人才居住证（B证）的待遇

　　

Article17(residencepermit)

　　

Theholdermayapplyforaresidencepermitvalidfornomorethanfiveyearsinaccordancewiththeprovisions.

　　

Fortheholderswhoarevalidfor5yearsormore,themunicipalhumanresourcesandsocialsecuritybureaucanissueahigh-leveltalentcertificateandapplyforaresidencepermitvalidfor5yearstotheexitEntryAdministrationDepartmentofthemunicipalpublicsecurityorgan.

　　

第十七条（居留许可）

　　

持证人可以按照规定申请办理有效期5年以内的居留许可。5年及以上有效期的持证人，可由市人力资源社会保障局出具高层次人才证明，向本市公安机关出入境管理部门申请办理有效期5年的居留许可。

　　

Article18(workpermit)

　　

Iftheholderisastudentstudyingabroadandhasjoinedtheforeignnationality,he/shecanapplyfortheworkpermitaccordingtothecurrentpracticeofthenewportareaofChina(Shanghai)pilotfreetradezone.

　　

第十八条（工作许可）

　　

持证人是留学人员且已加入外国国籍的，可按现行中国（上海）自由贸易试验区临港新片区做法办理工作许可。

　　

Article19(establishmentofenterprises)

　　

Theholdercansetupanenterpriseinthiscity,andthosewhomeettheconditionscanenjoyaseriesofentrepreneurialsupportpolicies,suchasventureguaranteeloan,socialinsurancesubsidyforstart-uporganizations,rentsubsidyforstart-upsites,andawardsforexcellentstart-upprojects.

　　

第十九条（创办企业）

　　

持证人可以在本市创办企业，符合条件的可享受创业担保贷款、初创期创业组织社会保险补贴、创业场地房租补贴、优秀创业项目奖励等一系列创业扶持政策。

　　

Article20(employmentbyadministrativeorgans)

　　

WiththeapprovaloftheadministrativeauthorityofthisMunicipality,theholdermaybeemployedbytheadministrativeorganintheformofshort-termemployment,projectemployment,etc.

　　

第二十条（行政机关聘用）

　　

持证人经本市有管理权限的部门批准，可以短期聘用、项目聘用等方式，接受行政机关聘用。

　　

Article21(socialinsurance)

　　

IftheholderworksinShanghai,inaccordancewiththerelevantprovisionsofthestateandthisMunicipality,hecanparticipateinthesocialinsuranceofthisMunicipality.Thepaymentperiodofbasicendowmentinsuranceandmedicalinsurancepaidbyunitsandindividualscanbeaccumulated.Hecanbetransferredandcontinuedwhenhisworkchanges.Ifhemeetstheconditions,hecanenjoythesocialinsurancetreatmentaccordingtolaw.Theunemployedspouseandchildrenunder18yearsoldorstudyinginhighschooloftheholdercanparticipateinthesocialinsuranceThecity'surbanandruralresidentsenjoybasicmedicalinsuranceandcorrespondingtreatment.

　　

第二十一条（社会保险）

　　

持证人在沪工作的，按照国家和本市有关规定，参加本市社会保险，单位和个人缴纳基本养老保险和医疗保险的缴费年限可累计计算，工作发生变动时可转移接续，符合条件的，依法享受社会保险待遇；持证人未就业配偶及未满18周岁或者高中在读的子女可以参加本市城乡居民基本医疗保险，并享受相应待遇。

　　

Article22(providentfund)

　　

IftheholderworksinShanghai,onthebasisofconsensuswiththeemployer,hecandepositthehousingprovidentfundaccordingtotherelevantprovisionsofthisMunicipality,withdrawthehousingprovidentfundandapplyforthehousingprovidentfundloanaccordingtotherelevantprovisionsofthisMunicipality.Incaseofdissolutionorterminationoflabor(employment)relationshipwiththeemployersinthiscity,theproceduresofsealingandtransferringthehousingprovidentfundaccountcanbehandledaccordingtotheregulations.

　　

第二十二条（公积金）

　　

持证人在沪工作的，在与用人单位协商一致的基础上可按本市有关规定缴存住房公积金，可按本市有关规定提取住房公积金和申请住房公积金贷款。与本市用人单位解除或终止劳动（聘用）关系的，可按规定办理住房公积金账户的封存、转移等手续。

　　

Article23(Educationofchildren)

　　

Ifthechildrenoftheholderareinthestageofpre-schooleducationorcompulsoryeducation,theymay,inaccordancewiththerelevantprovisionsofthisMunicipality,gothroughtheproceduresofstudyingaccordingtotheprincipleofproximitybytheadministrativedepartmentofeducationattheplaceofresidence.

　　

Thecertificateholderisastudentstudyingabroad,whosechildrenhavelivedabroadformorethan5yearsandparticipatedintheexaminationofjuniorhighschooltoseniorhighschoolinthiscitywithintheadaptationperiodofChineselanguage(3years),canappropriatelyreducetheadmissionscoreline;iftheirchildrenhavestudiedinSeniorHighSchoolinthiscityandobtainedthegraduationcertificateofseniorhighschool,theycanparticipateinthecollegeentranceexaminationinthiscityaccordingtotherelevantregulations,andtheyhavetherighttoapplyfortheexaminationinthiscity.

　　

第二十三条（子女教育）

　　

持证人子女在学前教育阶段、义务教育阶段的，可以根据本市有关规定，由居住地教育行政部门按照就近原则，办理就读手续。持证人是留学人员，其子女在国外生活5年以上并在国内语言文字适应期（3年）内参加本市初中升高中考试的，可以适当降低录取分数线；其子女在本市就读高中阶段并获得高中阶段学校毕业文凭的，可以根据有关规定在本市参加高考，报考在本市有招生计划的院校。

Theholdermay,inaccordancewiththerelevantprovisionsofthestateandthisMunicipality,participateintheassessmentorexaminationofprofessionalandtechnicalpostqualifications,theexaminationofprofessional(practice)qualificationsandtheregistrationofprofessional(practice)qualificationsinthisMunicipality.

　　

第二十四条（资格评定、考试和登记）

　　

持证人可以按照国家和本市有关规定，参加本市专业技术职务任职资格评定或者考试、职业（执业）资格考试、职业（执业）资格注册登记。

　　

Article25(specialfundfortalentdevelopment)

　　

IftheholderofthecertificateisareturnedstudentoraprofessionalfromHongKong,MacaoandTaiwan,he/shecanapplyfortherelevantspecialfundofShanghaispecialfundforpromotingtalentdevelopment.

　　

第二十五条（人才专项发展资金）

　　

持证人是留学回国人员、港澳台专才的，可按规定申请《上海市促进人才发展专项资金》的相关人才专项资金。

　　

Article26(facilitationofcustomsclearance)

　　

Iftheholderisanoverseashigh-leveltalent,theprocedurescanbesimplified.ThemunicipalhumanresourcesandSocialSecurityBureauwillissueacertificateofhigh-leveltalent,andthecustomswillprovideconveniencefortheentryandexitofscientificresearch,teachingandselfusearticlesbymeansofpersonalcarrying,separatetransportation,postaldeliveryandexpressdelivery.

　　

第二十六条（通关便利）

　　

持证人为海外高层次人才的，可简化手续，由市人力资源社会保障局出具高层次人才证明，以个人随身携带、分离运输、邮递、快递等方式进出境科研、教学和自用物品，海关给予通关便利。

　　

Article27(settlementinShanghai)

　　

HoldersofspecialtalentsofHongKongandMacaoresidentswhoholdthe"HongKongandMacaoresidentstravelpermittothemainland"andarevalidforthreeyearsormore,whovoluntarilygiveuptheiridentityasHongKongandMacaoresidentsandmeettheconditionsforsettlementinthiscity,canapplytotheexitEntryAdministrationBureauoftheMunicipalPublicSecurityBureauforsettlementinShanghai.

　　

第二十七条（来沪定居）

　　

持《港澳居民来往内地通行证》入境，3年及以上有效期的港澳居民特殊人才持证人，本人自愿放弃港澳居民身份，且符合在本市落户条件的，可以向市公安局出入境管理局申请来沪定居。

　　

Article28(permanentresidence)

　　

Foreigntalentholderswithavalidityperiodof5yearsormorewhomeettheconditionsforforeignerstoapplyforpermanentresidencecanbepreferentiallyrecommendedbythemunicipalhumanresourcesandSocialSecurityBureautoapplyforpermanentresidenceinChina.Foreignersholdingpermanentresidentidentitycardcandirectlyapplyfortheresidencecardofoverseastalentsthatmatchesthevalidityperiodoftheirpermanentresidentidentitycard.

　　

WewillexplorepilotprojectsforforeigntalentswhoworkandstartbusinessesintheYangtzeRiverDeltaecologicalandgreenintegrationdevelopmentdemonstrationzoneandhold"permanentresidentidentitycardforforeigners"toapplyforresidencecardsforoverseastalents.

　　

第二十八条（永久居留）

　　

5年及以上有效期的外籍人才持证人，符合外国人申请永久居留条件的，可由市人力资源社会保障局优先推荐申请在中国永久居留。持有《外国人永久居留身份证》的外籍人才，可直接申请办理与其《外国人永久居留身份证》有效期相匹配的海外人才居住证。探索试点在长三角生态绿色一体化发展示范区内工作、创业并持有《外国人永久居留身份证》的外籍人才申办海外人才居住证。

　　

Article29(financialservices)

　　

Iftheholdermeetstherequirements,hecanapplyforaRMBcreditcardintherelevantbank.Iftheholderpaystaxesinaccordancewiththelawandobtainsthetaxcertificateandrelevantcertificationmaterialsissuedbythetaxdepartment,he/shemay,inaccordancewiththerelevantprovisionsonforeignexchangemanagement,converthis/herlegalincomeduringhis/herstayinthiscityintoforeignexchangeandremititabroad.

　　

第二十九条（金融服务）

　　

持证人符合条件的，可以在相关银行申办人民币信用卡。持证人依法纳税并取得税务部门出具的税务凭证及相关证明材料的，可以按照外汇管理有关规定，将其在本市期间的合法收入兑换成外汇，汇出境外。

　　

Article30(handlingofdrivinglicense)

　　

Theholdermay,inaccordancewiththerelevantprovisionsofthestateandthisMunicipality,applyfororrenewamotorvehicledriver'slicenseandgothroughtheproceduresofmotorvehicleregistrationinthisMunicipality.

　　

第三十条（驾驶证照办理）

　　

持证人可以按照国家和本市有关规定，在本市申领或者换领机动车驾驶证、办理机动车注册登记手续。

　　

Article31(nonbusinessbusquotaauction)

　　

Theholdermay,inaccordancewiththerelevantprovisionsofthisMunicipality,applytoparticipateintheauctionofnonbusinesspassengercars.

　　

第三十一条（非营业性客车额度拍卖）

　　

持证人可以按照本市有关规定，申请参加非营业性客车额度拍卖。

　　

Article32(selectionandcommendation)

　　

Theholdermay,inaccordancewiththeprovisions,participateintherelevantmunicipalawardsandenjoycorrespondingtreatment.

　　

第三十二条（评选表彰）

　　

持证人可以按照规定参加本市有关评选表彰，并享受相应待遇。

　　

Article33(administrativeservices)

　　

Theholdercanregistertheappwithrealnameauthenticationandusetherelatedfunctionsofgovernmentservice.

　　

第三十三条（政务服务）

　　

持证人可以实名认证注册“随申办”APP，并使用政务服务相关功能。

　　

3Howtoapplyforoverseastalentresidencepermit(TypeB)

　　

3如何申请海外人才居住证（B证）

　　

Ifitisnecessarytoapplyfortheresidencepermitofoverseastalents,theapplicant'sunitshallapplytothehumanresourcesandsocialsecuritydepartmentthroughthe"onenetwork"systemofthecity.

　　

需要申办海外人才居住证的，由申请人所在单位通过本市“一网通办”系统向人力资源社会保障部门提出办理申请。

　　

Afterreceivingtheapplicationmaterials,ifthematerialsarecompleteandeffective,theacceptinginstitutionshallacceptthem;ifthematerialsareincomplete,theacceptinginstitutionshallinformtheapplicanttosupplementtherelevantmaterials.TheacceptancewindowshalltransfertheapplicationinformationandmaterialstothemunicipalhumanresourcesandSocialSecurityBureauwithin2workingdaysfromthedateofacceptance.

　　

受理机构收到申办材料后，对材料齐全有效的，应当受理；对材料不齐全的，应当告知申请人补齐相关材料。受理窗口应当自受理之日起2个工作日内，将申请信息、材料移送市人力资源社会保障局。

　　

TheMunicipalBureauofhumanresourcesandsocialsecurityshallcompletetheverificationwithin7workingdaysfromthedateofreceivingtheapplicationinformationandmaterials.Forthosewhomeettherequirements,awrittennoticeshallbeissued;forthosewhodonotmeettherequirements,awrittennoticeshallbegiventotheapplicant.

　　

市人力资源社会保障局应当自收到申办信息、材料之日起7个工作日内，完成核定。对符合条件的，出具书面办理通知；对不符合条件的，书面告知申请人。

　　

TheresidencepermitforoverseastalentsshallbeuniformlyissuedbytheMunicipalPublicSecurityBureau.Forthosewhomeettherequirementsafterverification,thecertificatemakingDepartmentoftheMunicipalPublicSecurityBureaushallcompletethecertificatemakingwithin10workingdays.TheexitEntryAdministrationBureauoftheMunicipalPublicSecurityBureauisresponsibleforissuingcertificates.Theresidencepermitofoverseastalentsshallbeissuedinaccordancewiththerequirementsofthemunicipalunifiedstandardsandregulations,andshallbecollectedintothemunicipalelectroniccertificatelibrary.Theelectroniccertificateandtheentitycertificatehavethesamelegaleffect.

　　

海外人才居住证由市公安局统一制发，对经核定符合办理条件的，由市公安局制证部门在10个工作日内，完成制证。市公安局出入境管理局负责发证。海外人才居住证按照市统一标准规范要求同步制发电子证，并归集到市电子证照库，电子证与实体证具有同等左边法律右边效力。
